How and why we use your information

UK data protection law requires us to have a lawful basis for processing your personal information. The lawful basis we rely on depends on why we are using the information.

To process and fulfil your orders

We use your information to process orders, take payment, arrange delivery, provide order updates, administer returns and refunds and provide customer support.

Lawful basis: performance of our contract with you.

To operate the Fool's Fix Promise

Where you make a claim under the Fool's Fix Promise, we process the information you provide, including your order information and any video or other information required under the Promise, to assess and administer your claim and process any refund due.

Lawful basis: performance of our contractual commitment to you under the Fool's Fix Promise.

Submitting content for the purpose of making a claim under the Fool's Fix Promise does not by itself give us permission to use that content for advertising or marketing. If we want to use your video, testimonial or other content publicly for marketing purposes, we will obtain the appropriate permission separately.

To administer the Fellowship

We process Fellowship information as described in more detail below in order to verify eligibility, administer registrations and ultimately facilitate the allotment and administration of shares.

Depending on the particular processing involved, our lawful bases are performance of our commitment to you, our legitimate interests in properly and accurately administering the Fellowship, and compliance with our legal obligations in relation to company and shareholder records.

Marketing

We may use your contact details to send you information about Fool's Fix, our products, promotions and other relevant news where you have consented to receive marketing or where applicable law otherwise permits us to contact existing customers about similar products.

Where we rely on consent, you can withdraw that consent at any time by using the unsubscribe link in an email or contacting us.

Lawful basis: consent or, where permitted by applicable law, our legitimate interests in marketing our products to existing customers.

Marketing consent for the Fellowship is separate and optional. You do not need to agree to receive marketing in order to register for shares.

To operate and improve our website and business

We may use information about how customers use our website and services to understand how the site is performing, troubleshoot problems, improve the customer experience, understand demand for our products and develop our business.

Lawful basis: our legitimate interests in operating, understanding and improving our website, products and business.

Where non-essential cookies or similar technologies require consent, we will obtain that consent before using them.

Fraud prevention and security

We may process personal information to detect and prevent fraud, misuse, security incidents and other unlawful activity and to protect our customers, website and business.

Lawful basis: our legitimate interests in protecting our customers and business and, where applicable, compliance with our legal obligations.

Legal and regulatory obligations

We may process and retain information where necessary to comply with our legal obligations, including tax, accounting, consumer protection and company law requirements, or to establish, exercise or defend legal claims.

Lawful basis: compliance with a legal obligation and, where applicable, our legitimate interests in establishing, exercising or defending legal claims.

Our legitimate interests

Where we rely on legitimate interests, we only do so where we consider that the processing is necessary for a legitimate business purpose and that your interests, rights and freedoms do not override those interests.

Our legitimate interests include:

  • operating and improving Fool's Fix and our website;
  • providing effective customer service;
  • understanding how customers use our products and services;
  • protecting our business and customers against fraud and misuse;
  • administering the Fellowship accurately;
  • preventing duplicate, fraudulent or ineligible Fellowship registrations;
  • maintaining accurate business and customer records;
  • marketing similar products to existing customers where permitted by law; and
  • establishing, exercising and defending our legal rights.

You have the right to object to processing based on legitimate interests in certain circumstances, as explained below.

The Fellowship

Anyone purchasing any of the three qualifying Fool's Fix packs can register to receive 100 ordinary shares in Fool's Fix Fellowship Ltd (company number SC899467).

Purchasing Fool's Fix does not itself result in shares being allotted. You must separately complete the Fellowship registration process.

Fellowship registration may collect:

  • full legal name;
  • residential or postal address;
  • date of birth;
  • purchase and order information;
  • confirmation that you wish to receive the future share allotment;
  • acknowledgement of the relevant privacy information; and
  • separate, optional marketing consent.

We use this information to:

  • verify your eligibility against Fool's Fix purchase records;
  • administer Fellowship registrations;
  • prevent duplicate, fraudulent or ineligible registrations;
  • monitor progress towards 20,000 valid registrations;
  • reconcile registrations against sales data;
  • communicate with you about your registration and the Fellowship;
  • prepare for and carry out the eventual allotment of shares;
  • issue and administer share certificates;
  • maintain the necessary company and shareholder records; and
  • provide the necessary information to our third-party share administration provider.

Our lawful basis for this processing is the performance of our commitment to you in connection with your Fellowship registration and our legitimate interests in administering the Fellowship accurately and preventing fraudulent, duplicate or ineligible registrations.

Where information must be processed or retained to comply with company law or other statutory requirements, our lawful basis is compliance with a legal obligation.

Marketing consent is separate and optional. You do not need to agree to receive marketing in order to register for your shares, and declining or withdrawing marketing consent will not affect your Fellowship registration or shareholding.

Once 20,000 valid registrations have been reached and reconciled against the relevant purchase records, 100 new ordinary shares will be allotted to each eligible registered person.

The necessary information will then be provided to our share administration provider for the allotment, issue of share certificates, maintenance of shareholder records and ongoing shareholder administration.

We may share personal information where necessary with organisations that help us operate Fool's Fix and provide our services, including:

  • Shopify, which hosts our online store and helps us process orders;
  • payment providers, which process payments;
  • our fulfilment partner and delivery carriers, including those responsible for storing, packing and delivering orders;

Where another organisation processes personal information on our behalf, we require it to process that information appropriately and in accordance with applicable data protection law.

We do not sell your personal information.

International transfers

Some of the organisations that provide services to us may process or store personal information outside the United Kingdom.

Where personal information is transferred outside the UK, we take appropriate steps to ensure that it receives an appropriate level of protection.

Depending on the destination and provider, this may include relying on UK adequacy regulations or appropriate contractual safeguards such as the UK International Data Transfer Agreement or the UK Addendum to the European Commission's Standard Contractual Clauses.

How long we keep your information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to satisfy legal, regulatory, tax, accounting and reporting requirements.

In particular:

  • customer-service and Promise-related information will be retained for as long as reasonably necessary to administer the relevant matter and deal with any subsequent queries or claims;
  • Fellowship registration information will be retained for as long as reasonably necessary to administer the registration process and eventual allotment;
  • shareholder information may need to be retained for longer where required for statutory company and shareholder records; and
  • marketing information will be retained until you unsubscribe or otherwise withdraw your consent, subject to retaining a limited suppression record where necessary to ensure we respect your preference.

Your rights

Under UK data protection law, you may have the right to:

  • access the personal information we hold about you;
  • correct inaccurate or incomplete personal information;
  • request deletion of your personal information in certain circumstances;
  • restrict how we process your personal information in certain circumstances;
  • object to processing based on our legitimate interests;
  • object to direct marketing at any time;
  • receive or transfer certain personal information in a portable format; and
  • withdraw consent at any time where we rely on consent.

These rights are not absolute and may be subject to exemptions under applicable law. For example, we may need to retain information where we have a legal obligation to do so, including certain tax, transaction, company and shareholder records.

Withdrawing consent does not affect the lawfulness of processing carried out before you withdrew it.

To exercise any of these rights, email hark@foolsfix.com.

We may need to ask you for information to verify your identity before responding to a request.

If you are unhappy with how we have handled your personal information, you can complain to the Information Commissioner's Office at ico.org.uk, or by calling 0303 123 1113.

Cookies

We use cookies and similar technologies to:

  • operate essential functions of the website;
  • remember your cart and preferences;
  • understand how visitors use the website;
  • measure website performance; and
  • where you consent, support analytics, advertising and marketing.

Essential cookies may be used where necessary to provide the website and services you request.

Non-essential cookies and similar technologies are only used where required consent has been obtained. You can change your choices at any time through the cookie settings available on the site.

We may update this Privacy Policy from time to time to reflect changes to our business, services, legal requirements or how we process personal information.
